1.ACCEPTANCE OF TERMS
By creating an account, downloading, or otherwise using Vulpine (the "App," the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Vulpine LLC, registered at 1209 North Orange Street, Wilmington, Delaware 19801, United States ("we," "us," "Vulpine").
2.ELIGIBILITY
You must be at least 15 years old to use Vulpine. If you have not reached the age of majority in your jurisdiction, you confirm that you have the permission of a parent or legal guardian to use the Service.
3.DESCRIPTION OF THE SERVICE
Vulpine is an end-to-end encrypted messaging application. Messages are encrypted on your device and can only be decrypted by the intended recipient or recipients. We do not hold the encryption keys necessary to read the content of your messages.
4.USER RESPONSIBILITY FOR CONDUCT AND CONTENT
You are solely and entirely responsible for your use of the Service, including but not limited to:
- All content you send, receive, store, or share through Vulpine.
- Compliance with all laws applicable to you in your jurisdiction.
- Any consequences arising from your communications or conduct on the Service.
- Maintaining the confidentiality of your account credentials and the security of your own device.
Because Vulpine is end-to-end encrypted, we have no technical ability to view, monitor, moderate, or filter the content of your messages. We therefore cannot and do not review, endorse, or take responsibility for any content transmitted through the Service. You acknowledge that you use Vulpine at your own risk with respect to the conduct of other users.
5.PROHIBITED USES
While we cannot monitor message content, you agree not to use Vulpine to:
- Violate any applicable local, national, or international law.
- Harass, threaten, defraud, or harm another person.
- Distribute child sexual abuse material or engage in the exploitation of minors in any form.
- Facilitate terrorism, violent extremism, or other serious crime.
- Distribute malware or attempt to compromise the security of the Service or of other users.
We reserve the right to suspend or terminate accounts we become aware of, through reports, metadata, or legal process, that are being used for the purposes above, to the extent technically possible given our lack of access to message content.
6.NO ABILITY TO ACCESS CONTENT
You acknowledge and agree that:
- We use end-to-end encryption such that message content is never accessible to us in readable form, at any point.
- We cannot, upon request from you, other users, or third parties including law enforcement, decrypt or hand over the content of your messages, because we do not possess the means to do so.
- We may still be legally compelled to provide any metadata we do hold, as described in the Privacy Policy, and will handle such requests in accordance with applicable law.
7.ACCOUNT TERMINATION
You may delete your account at any time through the App. We may suspend or terminate your account if you violate these Terms, subject to applicable law.
8.DISCLAIMER OF WARRANTIES
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, uninterrupted or error-free operation, or security beyond industry-standard encryption practices.
9.LIMITATION OF LIABILITY
To the maximum extent permitted by law, Vulpine LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service or the actions of other users, including content that cannot be recovered if lost due to encryption, as described in Section 10.
10.ENCRYPTION AND DATA LOSS
Because we do not hold your encryption keys, we cannot recover lost messages, accounts, or encrypted data on your behalf. If you lose your device, password, or recovery key, your data may be permanently unrecoverable. This is an inherent trade-off of end-to-end encryption and not a defect of the Service.
11.CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify users of material changes through an in-app notice or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12.GOVERNING LAW
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Switzerland.
